Ein derartiges Unterfangen macht eine strenge Auswahl erforderlich, und jeder wird bei einer solchen zum Teil davon beeinfluBt sein, was er im Hinblick auf die Problema­ tik der Gegenwart als wesentlich empfindet. Die Beiträge zur Altertumskunde enthalten Monographien, Sammelbände, Editionen, Übersetzungen und Kommentare zu Themen aus den Bereichen Klassische, Mittel- und Neulateinische Philologie, Alte Geschichte, Archäologie, Antike Philosophie sowie Nachwirken der Antike bis in die Neuzeit. Dadurch leistet die Reihe einen umfassenden Beitrag zur Erschließung klassischer Literatur und zur Forschung im gesamten Gebiet der Altertumswissenschaften.

Generationen von Studenten, von Arndts bis Windscheid, sassen in Marburg, Landshut und Berlin zu Fussen Savignys und lauschten in der Vorlesung dessen Worten. Ihr Vermachtnis sind ungewohnlich zahlreiche Vorlesungsnachschriften zu Pandekten, Institutionen, Romischer Rechtsgeschichte, preussischem Allgemeinen Landrecht, Methodologie und weiteren Materien, die Savignys Lehren von den Anfangen als junger Professor bis zum ungekronten Haupt der Rechtswissenschaft widerspiegeln. Da Savigny keine Lehrbucher publizierte und sein grosses Hauptwerk zum Privatrecht erst ab 1840 gedruckt wurde, lasst sich sein Einfluss auf die Rechtswissenschaft seiner (...) Zeit nur mit einem Blick auf die Vorlesungen vollumfanglich verstehen. Eine Reihe von Lehrstoffen ist ebenso nur hier uberliefert wie die Veranderungen im Laufe der Jahre. Die hohe Autoritat von Savignys sog. Kollegheften ist gut bezeugt und schon an der konkurrenzlosen Uberlieferungsdichte ablesbar. Seine zahlreichen Schuler und Horer rezipierten Savignys Lehren in ihren eigenen Vorlesungen und Publikationen und verstarkten damit ganz erheblich seine Wirkung als Lehrer und Forscher. Die Edition dokumentiert nach langjahrigen Recherchen diese enormen Quellen erstmals voll. Auch die Kontexte sind aufbereitet nach Horern, Stundenstatistiken und allen bekannten, weiteren Quellen. Die Edition stellt dazu in Wort und Bild fur den Zeitraum von 1802 bis 1842 die Vorlesungsmanuskripte und rund 140 erhaltene Nachschriften von den USA uber Europa bis nach Japan vor. Endlich kann man also gezielt auf Savignys Lehren zu bestimmten Fragen und aus bestimmten Zeiten zugreifen. (shrink)

Leben Totgesagte langer? Manche sicher, aber immer nur selektiv - Friedrich Carl von Savigny, dieser unser deutscher Starjurist vom Ursprung unserer juristischen Moderne, so global geworden wie kaum ein anderer, war gewiss so ein Fall von immer neuen Selektionen. Nur, so ist die Frage, wie selektiv, wann und wo? In diesem Band wird untersucht, welche seiner Denk-Stucke man verstand und wie oder ob doch gar nicht, in Frankreich, Italien, Spanien, Brasilien, England, U.S.A., Danemark, Schweden, Norwegen, Finnland, Russland, Japan und (...) China. 'Nicht- verstehen' konnte leicht geschehen an so ungleichen Zeiten, Orten, Politiken und Denkkontexten und geschah durchaus. Man kennt bisher nur diese und jene "Einflusse". Nun kommen ganze Denkweisen und Rezeptions-Bilder zur Sprache. Beide Aspekte werden in profunder Quellenbeherrschung erschlossen und analysiert. Und dies geschieht konsequent an bestimmten Schlusseltexten und Savigny-Bildern. So fliessen die Studien einmal nicht auseinander, sondern zeigen zum einen die Denk-Stucke selbst, dann ihre vielfaltigen Verwendungen in anderen Kontexten und schliesslich die Metamorphosen der Savigny-Bilder. Die Differenzierungen losen sich nicht irgendwohin auf, sondern sie werden zu sprechenden Gemeinsamkeiten und Unterschieden, Tendenzen und Strukturen. Eine summierende Schlussbetrachtung und eine erstmals umfassende Bibliographie der Ubersetzungen, systematisch nach Sprachen und chronologisch nach Werken geordnet, schliesst den Band ab. Carl Heinrich Seibt’s Prague Lectures on the Schöne Wissenschaften: The Beginnings of Aesthetics in Bohemia Carl Heinrich Seibt (1735–1806) was the founder of modern Bohemian aesthetics, that is, thinking about taste, beauty, and fine art, which he developed in a living language. Yet little is known about the content of his lectures on the Schöne Wissenschaften or his views on aesthetics. The following article aims to fill this gap in four respects. It explains why the topic has so (...) far been neglected; it gives a summary of the now known sources from which we may draw our knowledge of the topics of art theory, the individual kinds of art, and general aesthetics, with which Seibt was concerned in his lectures. It presents the standpoints which he held in them, and it puts them into the European context of the period, particularly German aesthetics. It aims primarily to determine whether the accessible sources contain traces of influences other than those of his teachers at Leipzig, who are mentioned in the secondary literature: Johann Christoph Gottsched (1700–1766) and Christian Fürchtegott Gellert (1715–1769), including the important authorities recognized by them, in particular Charles Batteux (1713–1780). The article shows that Seibt’s views were also influenced by Moses Mendelssohn and Johann Joachim Winckelmann, representatives of a generation of German aestheticians younger than his teachers. The Challenge of the Exception is the key that unlocked the ideas of Carl Schmitt, a leading political theorist and jurist who influenced the thoughts of, among others, Hannah Arendt, Carl Joachim Friedrich, Otto Kirchheimer, Hans Morgenthau, Franz Neumann, and Leo Strauss. Professor Schwab clearly articulates Schmitt's key concepts and relates their centrality to politics and the state, to the political theory of liberalism, democracy and authoritarianism, and to international relations. When Schwab treats Schmitt's interpretations of constitutional (...) questions, for example, he shows how political theory in Germany is inextricably linked with constitutional law, legal theory, and the country's history. Not content to merely deal with Schmitt's profound contributions to twentieth-century thought, Schwab devotes considerable space to the unconscionable compromises that he made with the Third Reich. This, however, failed to help him become the political and legal theorist of Hitler's Germany. Schwab shows how the new Schmitt was suspect from the beginning and, by 1936, Schmitt the hunter had become Schmitt the hunted. Schwab's presentation of the multifaceted Carl Schmitt exposes the reader to a truly interdisciplinary excursion into the humanities and social sciences. (shrink)

After National Socialism had destroyed any tradition in the history of thought, humanities in post-war Germany answered by criticizing this tradition, initiating a number of projects in the field of the history of concept. Erich Rothacker and Carl Schmitt, both compromised by National Socialism, can be seen here as predecessors of Joachim Ritter and also of Hans-Georg Gadamer. The letters, of which there are only a few, display consensus as well as dissent between the writers.

The objective of this article is to contribute to an understanding of Hannah Arendt’s special place in present-day political theory by means of a contrast between her Origins of Totalitarianism and four important political science studies of National Socialism and totalitarianism, three written by authors who shared the status of involuntary emigrant with Arendt, that are offered as constituting the original context of her work. A critical appreciation of the seminal works by Ernst Fraenkel, Franz L. Neumann, Sigmund Neumann, and (...) Carl Joachim Friedrich and Zbigniew Brezinski, with special emphasis on questions of method, opens the way to a reconsideration of the distinctly philosophical character of Arendt’s work, and its shocking challenges to the scientific orientations of political science. Richard Löwenthal’s response to the challenges of ‘1968’ was more complex than that of most of his liberal colleagues. He did not simply remain beholden to the interpretative patterns of a German ‘special path’ (Sonderweg). He also, and increasingly so, drew on the conceptual framework of ‘Western civilization’ to make sense of and cope with the socio-cultural transformations of his times. What many like-minded intellectuals perceived solely as a ‘deviation from the West’, he also viewed as a ‘crisis of the (...) West’. This article argues that this transnationally ‘Western’ stance was part and parcel of Löwenthal’s intellectual profile as ‘cold war liberal’. This was a relatively rare species in Cold War Germany, and Löwenthal was rather exceptional in his sustained engagement with the topic of ‘Western civilization’. Compared with luminaries such as Carl Joachim Friedrich, Ernst Fraenkel or Karl Loewenstein, Richard Löwenthal may be lesser known in English-speaking scholarship, but he makes for a particularly instructive case when discussing ‘cold war liberalism’ in West Germany. With its focus on the spatialization of political thought, and ‘the West’ as a spatial imaginary, this article also seeks to contribute to the growing discussion of how to ‘spatialize’ intellectual history. _Psychological Types_ is one of Jung's most important and most famous works. First published by Routledge in the early 1920s it appeared after Jung's so-called fallow period, during which he published little, and it is perhaps the first significant book to appear after his own confrontation with the unconscious. It is the book that introduced the world to the terms 'extravert' and 'introvert'. Though very much associated with the unconscious, in _Psychological Types_ Jung shows himself to be a supreme theorist (...) of the conscious. In putting forward his system of psychological types Jung provides a means for understanding ourselves and the world around us: our different patterns of behaviour, our relationships, marriage, national and international conflict, organizational functioning. Appearing in paperback for the first time this central volume from Jung's Collected Works will be essential to anyone requiring a proper understanding of Jung's psychology. (shrink)

In this paper we argue that knowledge in health care is a multidimensional dynamic construct, in contrast to the prevailing idea of knowledge being an objective state. Polanyi demonstrated that knowledge is personal, that knowledge is discovered, and that knowledge has explicit and tacit dimensions. Complex adaptive systems science views knowledge simultaneously as a thing and a flow, constructed as well as in constant flux. The Cynefin framework is one model to help our understanding of knowledge as a personal construct (...) achieved through sense making. Specific knowledge aspects temporarily reside in either one of four domains – the known, knowable, complex or chaotic, but new knowledge can only be created by challenging the known by moving it in and looping it through the other domains. Medical knowledge is simultaneously explicit and implicit with certain aspects already well known and easily transferable, and others that are not yet fully known and must still be learned. At the same time certain knowledge aspects are predominantly concerned with content, whereas others deal with context. Though in clinical care we may operate predominately in one knowledge domain, we also will operate some of the time in the others. Medical knowledge is inherently uncertain, and we require a context-driven flexible approach to knowledge discovery and application, in clinical practice as well as in health service planning. It is a common assumption in contemporary cognitive neuroscience that discovering a putative realized kind to be dissociably realized (i.e., to be realized in each instance by two or more distinct realizers) mandates splitting that kind. Here I explore some limits on this inference using two deceptively similar examples: the dissociation of declarative and procedural memory and Ramachandran's argument that the self is an illusion.

This paper develops a theory of how democratic governance is possible. It analyses democracy as a laminated system consisting of three interdependent levels – the political/institutional, the social/interactional, and the psychological/intrapsychic – each of which is necessary for the others to exist. Each level is subject to a regulatory principle that is necessary for it to function appropriately. At the political/institutional level, competing political parties must be governed by the regulatory principle of ‘loser’s consent,’ in which the losing party must (...) agree to cede power to the winning party. At the social/interactional level individuals from opposing political parties must be governed by the regulatory principle of a superordinate identity as citizen, which allows them to transcend their partisan political identities. At the psychological/intrapsychic level individuals must be governed by the regulatory principle of mutuality/thirdness which allows the possibility of an alternative to the binary identities that result from the doer/done-to position.
